The Supreme Court has ordered two former senior officers of the Uragasmanhandiya Police to each pay Rs. 1 million in compensation and legal costs from their personal funds after they were found guilty of violating fundamental rights by torturing a young man in 2019.
The ruling concerns the arrest and treatment of P.A.S. Madushan, who was accused in connection with a gold theft. Madushan voluntarily appeared at the police station with a lawyer but was later assaulted by then Officer-in-Charge of the Crimes Division and another officer.
The petition stated that Madushan was handcuffed, dragged into a room, and subjected to brutal assault, including acts targeting his genitals, causing him to lose consciousness. He was released on police bail after allegedly being forced to pay Rs. 300,000 and was hospitalized for 12 days due to his injuries.
The Supreme Court bench, comprising Justices Shiran Gunaratne, S. Thurairajah, and A.H.M.D. Nawaz, said the police failed to justify the arrest or disprove the allegations. Medical reports confirmed that Madushan had suffered severe torture.
The court also ordered that copies of the verdict be sent to the National Police Commission to initiate disciplinary action against the two officers, identified as then OIC Harith and Crimes Division OIC Hiran. (Newswire)
